These Terms & Conditions (“Terms”) are the agreement between you and Themes Live (“we”, “us”) for your use of the Themes Live app and related services (the “App”). Please read them. By creating an account or using the App you agree to them, and to our Privacy Policy. If you do not agree, do not use the App.
Who can use Themes Live
- You must be at least 18 years old and able to form a binding contract where you live.
- You must not be banned from the App, and you must follow the law that applies to you.
- If you use the App for a business, such as an agency, you promise you have authority to accept these Terms for it.
Your account
- You can sign up with Google or use Quick Login. A Quick Login account is tied to the app installation on your phone. If you uninstall the app or clear its data, you can permanently lose access. Sign in with Google to keep your account on a new device.
- Give accurate information and keep it up to date. One person may not run accounts to evade a ban, to cheat, or to inflate rankings.
- You are responsible for everything done through your account. Do not share it, sell it, rent it, or transfer it to anyone else.
- Tell us right away at hmdbillal8490@gmail.com if you think someone is using your account.
Your content
- You own what you create. You are responsible for it, and you promise you have the right to post it (including any music, images or video in it).
- You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, stream, adapt and distribute your content, and your name and profile, as needed to operate, promote and improve the App. This licence ends when your content is deleted, except for copies that others have already shared, or that we must keep by law.
- Live streams and public posts are visible to other people and may be recorded by them. We are not responsible for what other users do with your content.
Community rules
Do not use the App to post, stream or do any of the following:
- Nudity, sexual content or sexual services, or anything involving minors in a sexual or harmful way.
- Violence, threats, self-harm encouragement, terrorism, or dangerous or illegal activity.
- Hate speech, harassment, bullying, stalking, doxxing, or sharing someone’s private information.
- Impersonation, fake identities, scams, phishing or misleading offers, including fake coin sales.
- Spam, mass unsolicited messages, or fake followers, views or gifts.
- Content you do not have the right to use, including copyrighted music or video.
- Promoting real-money gambling, drugs, weapons, or other products and services that are illegal where you or your audience are.
- Cheating, exploiting bugs, using bots or modified apps, reverse engineering, or trying to break the App’s security.
- Recording or sharing other people’s streams or private chats without their permission.
Live streaming and hosts
- You are responsible for what happens on your live stream, including your guests and your chat.
- We may end a stream, remove content, or restrict features at any time if we think a rule has been broken or someone may be at risk.
- You must have permission from anyone clearly shown or heard on your stream.
- Beauty and filter effects are cosmetic. They run on your device, and we do not guarantee how they look on every device or camera.
Reporting, moderation and bans
- You can report users and content and block users from inside the App. We review reports using people and automated tools.
- If you break these Terms we may warn you, remove content, mute you, suspend or permanently ban your account, and ban the device you used, for a limited time or permanently.
- Trying to get around a ban, for example by creating new accounts, can lead to a longer or permanent ban.
- If you think a decision was a mistake, write to hmdbillal8490@gmail.com with your user ID and we will take another look. We do not have to reverse a decision.
Virtual currency and gifts
- You can buy virtual coins or diamonds (“Virtual Currency”) and use them to send gifts and buy in-app items such as frames, rides and memberships. It may appear in the App as Coins, Diamonds or similar.
- Virtual Currency is not money. It has no cash value, cannot be exchanged for cash by you, and is not a bank deposit. You get a limited, personal licence to use it in the App.
- Purchases are made through Google Play and are also subject to Google Play’s terms. Prices are shown before you pay. All sales are final and non-refundable, except where the law or Google Play’s refund rules say otherwise.
- Sent gifts and spent coins cannot be taken back, even if you sent them by mistake.
- We may authorise independent resellers to sell Virtual Currency. A purchase from a reseller is between you and the reseller. Buy only from resellers shown in the App. We are not responsible for purchases from anyone else.
- If your account is closed because you broke these Terms, any unused Virtual Currency may be forfeited.
- We may change prices, packages, features and exchange rates at any time.
Host earnings, agencies and withdrawals
- Hosts receive gifts that are credited to an earnings balance (shown in the App as Rewards, rCoin or similar). Earnings can be converted into Virtual Currency or, where the App offers it, withdrawn as money once you reach the minimum shown in the App.
- To withdraw, you may have to verify your identity and give accurate payout details. Fees, exchange rates, minimum amounts and processing times are shown in the App and can change.
- You are responsible for any tax on your earnings.
- We may delay, withhold or reverse earnings and withdrawals that we reasonably believe came from fraud, self-gifting, fake accounts, refunds or chargebacks, or a breach of these Terms.
- Agencies are independent from us. A host who joins an agency does so under that agency’s own arrangements. We are not a party to private arrangements between hosts and agencies and are not responsible for promises an agency makes beyond what the App shows.
Games
- Games in the App are provided for entertainment and are played with in-app Virtual Currency. They do not involve real-money wagering, and winnings are not paid out in cash.
- Many games are run by outside providers. Their own rules and privacy policies also apply, and we are not responsible for how those games work.
- If you feel your gaming is becoming a problem, please stop playing and ask for help.
Third-party services and links
The App may link to or use services run by others, such as Google, game providers and websites opened inside the App. We do not control them and are not responsible for them.
Our rights and copyright
- The App, its design, software, names and logos belong to us or our licensors. You may use the App only as these Terms allow.
- If you believe content in the App infringes your copyright, email hmdbillal8490@gmail.com with the content’s location, proof that you own the rights, and your contact details. We may remove the content and ban repeat infringers.
Ending your use
- You can stop using the App and delete your account at any time in Profile → Settings → Delete Account. See the Privacy Policy for what happens to your data.
- We may suspend or end your access, immediately and without refund, if you break these Terms, if the law requires it, or if we stop offering the App.
- Sections that by nature should continue (content licence, payments, disclaimers, liability, governing law) continue after your account ends.
No guarantees
The App is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free or always available, or that other users will behave well. Live content is posted by users, and we do not endorse it. Use your own judgement and take care when you meet or pay people you meet online.
Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, data or goodwill, arising from your use of the App. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, and you may have consumer rights that these Terms do not take away.
If you cause us a loss
You agree to cover us for claims, losses and costs (including reasonable legal fees) that come from your content, your breach of these Terms, or your breach of someone else’s rights.
Changes to these Terms
We may change these Terms or the App. If a change is important we will tell you in the App or by another suitable method before it takes effect. If you keep using the App after the change, you accept it. If you do not accept it, stop using the App and delete your account.
Governing law and disputes
These Terms are governed by the laws of Malaysia, without regard to conflict-of-law rules, and disputes will be handled by the courts there, except where your local consumer-protection law gives you the right to go to court in your own country. Please contact us first so we can try to solve the problem informally.
